Challenges of the State's Digital Transformation: Analysis of the Legality of AI in Administrative Procedures

Artificial Intelligence (AI) has been massively integrated into public administrations, but its use lacks specific regulation in Chile, generating legal uncertainty and risks to the rights of citizens. This paper seeks to analyze the legality of AI use in administrative procedures and determine the limitations of its use to protect citizens. This is done through a doctrinal and legislative study, mainly of Spanish law, which contrasts the advances of European law with Chile’s delayed digital transformation. It concludes that AI can be legally used in administrative procedures, but legal gaps remain that must be addressed by the legislature
